Section 9-1-35.10 sets the zoning standards for any home occupation in a Laguna Niguel residential district. An applicant submits a home occupation permit application to the Community Development Department along with a fee set by the city council, and the director approves the permit only if it meets the section's performance and development standards. The home occupation must stay incidental and accessory to the residence: it cannot change the dwelling's principal character or use, and only people who actually live in the unit may work in it, so hired employees who do not reside on the property are barred.

Work is confined to the enclosed living area of the house or the garage, provided the garage still has room for the required off-street parking, and the operation cannot occupy more than 25 percent of the combined floor area of the house and garage. A home occupation may not be run out of a detached accessory structure, though that structure can be used for storage. Electrical or mechanical equipment that causes interference with neighbors' radio, television or telephone reception, or that spikes utility use beyond normal residential levels, is prohibited, as is hazardous-material storage and excess dust, noise, glare or odor.

Instructional home occupations serving a limited number of students need neighbor consent plus a minor use permit under § 9-1-114. Permits are nontransferable: they run only to the person named and only for the approved use, so a change in operator or activity requires a new application.
