Under Laguna Niguel Zoning Code Section 9-1-35.10, home occupations are permitted in all residential zoning districts as an incidental accessory use to a residence, subject to a Home Occupation Permit. The use may not change the principal character of the dwelling. Only residents may be engaged in it. The activity may occur only within the enclosed living area or garage, provided it does not block required off-street parking, and may not occupy more than 25 percent of the combined floor area of house and garage. It may not be conducted within a detached accessory structure, although materials may be stored there. Issuance does not override applicable Federal, State, or local rules or private CC&Rs.
Form 210 states that any violation of the listed restrictions causes the Home Occupation Permit to become null and void. Operating without the permit, exceeding the floor-area limit, or using a detached accessory structure subjects the resident to zoning enforcement.
