Under California law, small and large family child care homes are treated as a residential use in Laguna Niguel. State law (SB 234, Health and Safety Code 1597.40 et seq.) bars the city from requiring a special zoning or use permit in residential zones.
California's Child Day Care Facilities Act and Senate Bill 234 (effective January 1, 2020) classify both small (up to 8 children) and large (up to 14 children) family child care homes as a residential use. Under Health and Safety Code Sections 1597.40 through 1597.465, a city may not require a business or zoning permit, conditional use permit, or variance for such a home in a residential zone beyond what a single-family residence requires, and may no longer impose special spacing, traffic, parking, or noise rules on large homes. Providers are licensed by the state Department of Social Services, Community Care Licensing, not the city. The use is residential and is not restricted as a home occupation.
A city attempt to require a discretionary zoning or use permit for a family child care home in a residential zone conflicts with state law. Operating without the required Community Care Licensing license is a violation. Nuisance rules still apply.
