Encinitas Zoning Code permits home occupations as accessory uses in all residential zoning districts subject to conditions designed to preserve the residential character of neighborhoods. The business must be conducted entirely within the dwelling unit or an approved accessory structure. No external evidence of the business may be visible from the street, including signage, product displays, or commercial vehicle parking. The business must not generate traffic, noise, odors, or other impacts beyond what is typical for a residential neighborhood. Only residents of the dwelling may be employed in the home businessβno outside employees may report to the residence. Customer visits must be limited and by appointment only. The business may not occupy more than 25% of the total floor area of the dwelling. Storage of hazardous materials beyond normal household quantities is prohibited. Deliveries must be consistent with residential delivery patterns. Online businesses and professional services that operate without customer visits are generally the most compliant home business types. Operating a business that violates home occupation conditions may result in code enforcement citations with fines starting at $100 per day. Continued violations may result in revocation of the home occupation use and referral to the Code Enforcement Board.
