Under City of Springfield Zoning Code Section 155.001, a "home occupation" is a use or activity which conforms to Section 155.045, conducted entirely within a dwelling unit by persons who reside therein. Section 155.045(c) sets the operating standards: the home occupation must not result in any alteration of the appearance of the dwelling unit; must be clearly incidental and secondary to the primary residential use; must have no exterior storage of materials and no exterior indication except one sign not exceeding two square feet; must not produce noise, vibration, light, odor, dust, fumes, smoke, or traffic detectable outside the dwelling; must not involve storage of goods or materials exceeding 25 square feet; must not involve retail sales except those incidental to the home occupation; is limited to an area of the residence not exceeding 200 square feet including storage; limits customers to one at a time and no more than eight per day; and limits client/customer hours to 7:00 a.m. to 8:00 p.m. Home occupations are listed among permitted uses in the City's residential zoning districts. Springfield's power to enact these zoning standards comes from the Illinois Municipal Code, 65 ILCS 5/11-13-1, which authorizes municipalities to classify, regulate, and restrict the location of trades, industries, and buildings for residential, business, and other uses.
A home occupation that exceeds the 200-square-foot area, the 25-square-foot storage limit, the customer or hours limits, or otherwise fails the Section 155.045(c) standards is not a permitted accessory use and is subject to City zoning enforcement, including the City Code's general penalty provisions.
