Tree removal permit rules in Baldwin Park, CA — sometimes called heritage tree, protected tree, or street tree ordinances — list which trees require a permit before you can cut them down.
Baldwin Park requires a permit from the Tree Officer to remove a Mature Tree or Required Tree on private property, granted only on specific findings (hazard, disease, solar access, hardship, or replacement). Public (street) trees are removed only by the city, which gives abutting owners 10 days' written notice.
Under Zoning Code Subchapter 153.165 (Tree Preservation and Protection), Section 153.165.090.A, no person may remove a Mature Tree or Required Tree on private property without first obtaining a permit from the Tree Officer. A 'Mature Tree' is defined in Zoning Code Section 153.220 as any yard or setback tree that is greater than 18 inches in diameter measured 54 inches above ground, or greater than 40 feet in height, or a tree of historic value. The Tree Officer may grant a removal permit only if one of these findings is made: the tree is a nuisance or hazard by condition, location, species or proximity to structures/utilities; removal is needed to protect nearby trees from disease/infestation; substantial trimming or removal is needed for solar access under the Solar Shade Control Act of 1979; removal is needed to prevent substantial inconvenience or financial hardship; or a suitable replacement will be planted within six months. The Tree Officer sets the replacement tree's size, species and location. For Public Trees, Section 153.165.080.A reserves removal to city crews/contractors, and Section 153.165.080.F requires at least 10 days' written notice to abutting owners (and notice to the Tree Advisory Board when five or more trees are removed in an area). Imminent-hazard removals directed by police, LA County Fire or Public Works are exempt (Section 153.165.100.A).
Removing a Mature or Required Tree without a permit, or injuring a Public Tree, violates Subchapter 153.165. Decisions are appealable per Section 153.210.150; Code Enforcement citations run $100 / $200 / $500 per violation.
