050, in the noxious weed and refuse chapter, makes it unlawful for an owner, occupant or anyone controlling or managing a lot, place, area or parcel of land in the city to permit weeds, grass, brush or other deleterious or unhealthful growth of any species or variety to exceed nine inches in height above ground level, or to permit refuse or debris to accumulate, whether on the parcel itself or in the unpaved portion of an adjacent public right-of-way. 040 for noxious weeds, meaning it must be addressed as often as necessary to prevent the growth from getting out of hand. 060, charging the cost back to the owner as a lien on the property if unpaid.
Violations & Fines
Knowingly refusing or neglecting to cut, destroy or remove overgrown weeds, grass, brush or refuse exceeding 9 inches is a violation under Section 8.40.050(B), subjecting the owner or occupant, upon conviction in a court of competent jurisdiction, to the general penalty imposed by the code. The city can also abate the nuisance itself and bill the owner under Section 8.40.060.
