Section 14-22(e) lists exclusions from the noise section's prohibitions, and subsection (5) covers any landowner, property management company or renter during a state of declared emergency or during times when electric power is not generally available within an area, for the noise generated by electric generation machines, subject to three conditions: the generator must be sited to minimize sound to surrounding land uses, it cannot be louder than a similar well-maintained generator, and a code or law enforcement official can require it to be enclosed on three sides.

The section adds that the city manager may still set further limits on generator use by land use, day, hour or type of unit, and a code officer can order a generator relocated to cut noise even where the exemption otherwise applies. Subsection (6) narrows the exemption for routine upkeep: testing or inspecting a generator outside of an actual emergency is only exempt from 9:00 a.m. to 4:00 p.m., and for no more than thirty minutes in a given month. Outside a declared emergency, a power outage, or that limited monthly test window, running a generator that creates excessive noise falls back under the general Section 14-22(b) prohibitions and the Section 14-22(g) fine schedule, which runs from up to $100 for a first conviction to $500 for a third or later conviction.
