Lakeville, MN Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Section 4-1-4-1 of the Lakeville City Code, part of the nuisance chapter, targets amplified and electronically produced sound rather than every loud noise. Subsection A prohibits using or permitting the use of a radio receiving set, musical instrument, phonograph, tape or disc player, paging system, or other sound-producing machine in a distinctly and loudly audible manner that unreasonably disturbs the peace, quiet, and comfort of anyone nearby, a general standard that applies at any hour. Subsection B then supplies an objective nighttime test: operating such a device between ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. so that it is plainly audible at the property line of the structure where it is located, in an adjacent hallway or apartment, or fifty feet (50') away if the source sits outside a building, is prima facie evidence of a violation, meaning the City does not have to separately prove the sound was unreasonable during those hours.

Violating section 4-1-4-1 falls under the citywide general penalty in section 1-4-1, so it is a misdemeanor punishable under section 1-3-2 by up to ninety (90) days in jail, a fine of up to one thousand dollars ($1,000.00), or both. Subsection D also lets Lakeville Police seize the offending device as evidence and pursue forfeiture under Minnesota Statutes section 169.1217, adopted by reference. Lakeville Police officers respond to amplified-sound complaints from apartment neighbors, downtown bars, and backyard parties alike, and a citation can issue on a single documented instance of a device plainly audible at the property line after 10:00 P.M.
