Lakeville, MN Noise Ordinances: Construction Hours (2026)

Section 4-1-4-2 of the Lakeville City Code sets fixed nighttime hours rather than a decibel limit for construction noise. Subsection A bars four categories of activity between ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M.: grading activity, including operating, repairing, servicing, or the engine start-up and warm-up of heavy equipment under item 1; the use of power tools for construction such as saws, jackhammers, nail drivers, impact wrenches, and air compressors under item 2; domestic power maintenance equipment under item 3; and the repair or servicing of motor vehicles, recreational vehicles, or other equipment under item 4.

Subsection B carves out five exemptions so the rule does not stall essential work: mining and excavation already covered by a mining and excavation permit; activities and land uses regulated under a conditional use permit, such as fuel facilities, fast food establishments, major auto repair, school activities, and daycare facilities; public work construction performed by federal, state, county, or city authorities or their contractors as approved by the City Engineer; snow removal equipment; and emergency public works repair or construction. A builder working on a Spirit of Brandtjen Farm home site or an Airlake Industrial Park project has to stop grading, power-tool work, and vehicle servicing at 10:00 P.M. unless one of those five exceptions applies.

Because chapter 4-1 sets no separate fine for section 4-1-4-2, a violation carries the citywide general penalty in section 1-4-1, a misdemeanor punishable under section 1-3-2 by up to ninety (90) days in jail, a fine of up to one thousand dollars ($1,000.00), or both, enforced by the Lakeville Police Department and code enforcement staff.
