Full Breakdown
Section 8.28.020(H) bars "the construction, including excavation, erection, demolition, alteration or repair of any building, streets and highways" outside the hours of 6:00 a.m. and 9:00 p.m., except for urgent public-health-and-safety necessity or minor work that doesn't create a neighborhood noise disturbance. The building official may authorize work between 9:00 p.m. and 6:00 a.m. on request if satisfied that public health and safety won't be impaired and no party will suffer loss or inconvenience. Two carve-outs extend the morning start to 5:00 a.m. between April 1 and September 30: construction in a declarant-controlled common-interest community, and any project more than 300 feet from an occupied residential unit. "Common-interest community" and "declarant-controlled" borrow their definitions from NRS 116.021, and "residential unit" means a single-family residence or an individual unit in a multifamily building, excluding timeshares. The section was most recently amended by Ordinance No. 3258 on October 15, 2025.
Violations & Fines
Construction outside permitted hours without a building-official exception is a misdemeanor under Section 8.28.040: a fine up to $1,000, up to six months in city jail, or both. The City may also issue a civil citation under Chapter 8.70 starting at $250 for a first offense and $500 for a repeat within two years, plus daily civil penalties of up to $1,000 for commercial sites while the violation continues.
