Tamarac, FL Noise Ordinances: Construction Hours (2026)

Section 9-91 of the City of Tamarac Code, titled Same, Noisy businesses, work, etc., generally, restricts when audible work or business activity may occur in a noise sensitive area, defined under Sec. 9-86(c) to include property normally used for sleeping or as a school, church, hospital or public library. Outside the 8:00 a.m. to 6:00 p.m. window, it is unlawful to perform labor or work, or to operate or conduct any business or enterprise, if the activity creates noise that is plainly audible from a distance of fifteen feet or from the property of another; no decibel measurement is required, only that the sound is audible at that range during the restricted hours.

The section builds in a variance route: if an emergency exists, or if operating conditions make it unjust or inequitable to halt work during the prohibited hours, the operator can apply to the city manager, who may, after investigating, issue a temporary permit authorizing extended hours and attach conditions, capped at forty-five days. Any extension beyond forty-five days requires the city commission itself to act by resolution, and the commission may likewise attach conditions to that longer permit. 9-86's definitions of noise sensitive area and plainly audible, and its violations are processed the same way as every other Article III offense, through a sworn complaint or an officer's independent observation under Sec. 9-95, followed by a hearing before the special magistrate.
