Baldwin Park sets numeric noise standards in BPMC 130.34 (Ambient base noise levels). Subsection (A) makes it unlawful to produce noise received on property occupied by another person, within the designated zone, in excess of: R-1 (single-family residential) 55 dBA day / 45 dBA night; RG and R-3 (residential garden and high-density multi-family) 60 dBA day / 55 dBA night; Commercial 65 dBA day / 60 dBA night; and Industrial 70 dBA day and night. 'Day' is 7:00 a.m. to 7:00 p.m. and 'night' is 7:00 p.m. to 7:00 a.m. per BPMC 130.31. At the boundary between a residential and a commercial/manufacturing property, 'the noise level of the quieter zone shall be used.' Subsection (B) (Corrections to noise limits) adjusts the limits: subtract 5 dB for repetitive impulsive noise, pure tones, or cyclically varying amplitude, or for a steady whine, screech or hum; and add corrections for shorter-duration noise - +2 dB for noise more than 5 but less than 15 minutes per hour, +5 dB for more than 1 but less than 5 minutes per hour, and +7 dB for less than 1 minute per hour. Measurements follow BPMC 130.32-130.33 (A-weighting, slow response, taken at the receptor's property line about 10 feet from any building or obstruction, averaged over 15 minutes). These are the City's own standards under its Municipal Code; Los Angeles County's standards apply only to unincorporated land.
Noise measured at the receiving property above the BPMC 130.34(A) limit for the applicable zone and time, after applying the BPMC 130.34(B) corrections and the BPMC 130.33 measurement procedure, is a violation. A suspect source is measured only when it is 5 dBA or more above other nearby noise (BPMC 130.33(F)). Enforcement is under the general penalty BPMC 10.99 (misdemeanor up to $1,000 / 6 months unless made an infraction).
