Such sources are measured against the residential exterior limits in Section 11.16.040: 55 dBA from 7:00 a.m. to 10:00 p.m. and 50 dBA from 10:00 p.m. to 7:00 a.m., taken at any point on the affected residential property. If the equipment produces a steady tone (a 'simple tone noise'), the applicable limit is reduced by 5 dBA. The duration-versus-level structure means continuous mechanical hum is judged against the base limit, while short peaks get limited headroom, capped at the standard plus 20 dBA. A facility that cannot immediately comply may apply to the Noise Variance Board under Section 11.16.100 (a $75 fee), which can grant time to comply subject to conditions including limits on noise levels and operating hours. Emergency machinery and utility work restoring service are exempt under Section 11.16.060(C). Land-use compatibility for new industrial or commercial projects is also addressed through the city's General Plan noise element and CEQA review, separate from this enforcement code.
A fixed industrial or commercial noise source that exceeds the Section 11.16.040 limits at a neighboring residential property is a Chapter 11.16 violation. Under Sections 1.01.200-1.01.260 it is a misdemeanor punishable by up to $1,000 and/or six months jail, prosecutable as an infraction. The Noise Variance Board may instead set a compliance schedule and operating conditions.
