Lake Forest, CA Noise Ordinances: Aircraft Noise (2026)

Aircraft noise is one area where the City of Lake Forest has no enforceable local ordinance, and that is by design of federal law. Under the Noise Control Act of 1972 and decades of case law (notably City of Burbank v. Lockheed Air Terminal, 411 U.S. 624 (1973)), the FAA has primary authority over aircraft operations, flight paths and noise, and states and cities are preempted from independently regulating them. The Airport Noise and Capacity Act of 1990 (ANCA) and the FAA's Part 161 process further require federal review before any local airport noise or access restriction affecting jet aircraft can take effect. Lake Forest's Municipal Code recognizes this: Section 11.16.060(I) exempts from the noise chapter 'any activity to the extent regulation thereof has been preempted by State or Federal law,' which covers aircraft overflights. The city is located in south Orange County; the nearest commercial airport is John Wayne Airport (Santa Ana/Orange County), whose operator, the County of Orange, has stated that the FAA and the pilot-in-command have sole jurisdiction over flight paths and that only the FAA can enforce flight-related issues. Residents disturbed by aircraft noise generally must direct complaints to the airport's noise-abatement office or the FAA, not to Lake Forest code enforcement. Ground-based airport equipment and on-property activities could still fall under local rules, but flights themselves do not.
