Lenexa, KS Noise Ordinances: Quiet Hours (2026)

Lenexa does not print a single flat quiet hour. Section 3-9-E-3 makes it unlawful to make or continue any excessive, unnecessary, unreasonable or unusually loud noise, or any noise that annoys, offends, disturbs, injures or endangers the comfort, repose, health, peace or safety of a reasonable person of normal auditory sensitivity residing in the area. That standard applies at every hour. The nighttime window works as a shortcut for proof.

The code's prima facie rule says that operating any tool, equipment, vehicle, electronic device, instrument, television, phonograph, machine or other sound-producing device so that it is plainly audible across a property boundary line in a residential area, or for fifty feet or more in the case of a multiple-family dwelling, between 7:00 P.M. and 7:00 A.M. is prima facie evidence of a violation. In practice, an officer standing at the property line at 10 P.M. and hearing your speaker clearly does not need to prove anything further about how loud it was.

The section also targets parties. It is unlawful to congregate because of, participate in or be in a party or gathering from which sound of sufficient volume emanates to disturb the peace, quiet or repose of a reasonable person in a residential area, and no person may visit or remain in the dwelling unit except people who came solely to abate the disturbance. A police officer can order everyone to disperse from the dwelling in lieu of charging them.

Four exceptions apply: sound from law enforcement and other emergency vehicles, including snow-clearing equipment; sound from City, state, county, federal, school or utility vehicles and equipment preparing for or remedying a hazardous situation where immediate physical trauma or property damage is occurring or threatened; sound made under a valid license or permit that specifically allows it from a City department, board or commission; and emergency generators used when grid electricity is unavailable. Section 3-9-E-3 has no penalty clause of its own, so Section 3-9-J-1 sends a conviction to Section 1-1-C-3.
