Gaithersburg, MD Noise Ordinances: Vehicle Noise (2026)

Section 15-8(c) of the Gaithersburg City Code prohibits noise discharged from any motor vehicle or motorcycle, or the operation of one, in a manner that disturbs the peace and quiet of city residents. The section spells out four specific sources the prohibition reaches: engine noise, exhaust noise, tire noise, and music played from the vehicle, plus a catch-all for improper use of the horn. Unlike the lawn-equipment and stereo clauses in the same section, subsection (c) does not set fixed hours; a vehicle can violate it at any time of day if the noise it produces disturbs the peace and quiet of residents.

Because subsection (c) is part of the broader Section 15-8 nuisance ordinance, it is enforced the same way: Section 15-19 makes a violation a misdemeanor punishable as provided in Section 1-7 of the code, a fine of up to $500, imprisonment of up to 90 days, or both, at the court's discretion. Gaithersburg police typically use this provision against modified exhaust systems, aftermarket mufflers, revving engines late at night and car stereos played loudly enough to carry into nearby homes, and an officer can issue a citation under Section 1-8 in lieu of an arrest. The provision was adopted by Ordinance No. O-5-95 on June 5, 1995.
