2, adopted by Ordinance 4570 on December 6, 1984, sits in Chapter 24, Article I among Irving's general offenses, right next to the separate ban on obstructing streets and sidewalks. Subsection (a) is an outright prohibition: no person may paint or apply other markings to a street, curb, or sidewalk. Subsection (b) then lists the only three affirmative defenses a person charged under the section can raise. First, someone employed by or under contract with a government agency responsible for maintaining or marking the street who was painting or marking it as part of that official duty or contract.

Second, someone painting the address number on the curb in front of the corresponding premises, provided they are the owner or occupant, or have obtained the owner's or occupant's written permission first. Third, if the street, sidewalk, or curb in question was not along a public street or within a public right-of-way at all, the ordinance simply does not reach it. Because the section itself sets no dedicated fine, a violation falls under the citywide general penalty in § 1-6: a fine not exceeding $500, with each day the unauthorized marking remains treated as a separate, continuing offense.
