Section 50-43(b) allows the overnight requirement to be varied by the village mayor and board of trustees (the code's 1970s-era text for what is now the village president and board), through a formal process: a petitioner submits an application to a traffic committee appointed by the village administrator, made up of representatives from the police department, fire department, public works and engineering department, and community development department.

Section 50-43(c) directs the committee to weigh whether granting the variance would jeopardize the health, safety, and welfare of village residents generally or of the immediate neighborhood or subdivision, then forward its findings and a recommendation to the village president and board of trustees for a final decision.
