Gilbert, AZ Parking Rules: Overnight Parking (2026)

Section 62-74, added by Ordinance No. 2412 in December 2012, is Gilbert's overnight parking authority. Subsection (a) authorizes the town to prohibit overnight parking on town-owned property. Subsection (b) makes it unlawful for any person to park a vehicle overnight at any location where the town has posted signs prohibiting overnight parking: the restriction is sign-triggered rather than a blanket citywide overnight ban, so a driver must check for posted signage at the specific lot or street. Gilbert layers this with Section 62-68, Parking Time Limits on Certain Streets, which lets the town council set, by resolution, the maximum time a vehicle may be parked on any block where time-limit signs have been erected; violating a posted time limit is separately enforceable even outside overnight hours.

Because both sections fall under Chapter 62, Article III (Stopping, Standing and Parking), the town's traffic engineer or the police department administers sign placement and enforcement, and Section 62-66 creates a presumption that the vehicle's registered owner is responsible for a parking violation shown by the vehicle description in the citation. A vehicle found in violation of either section may be moved, at the owner's expense, to a place where parking is permitted under Section 62-67(b).
