Grand Junction, CO Public Conduct: Aggressive Panhandling (2026)

Grand Junction adopted its panhandling ordinance on an emergency basis (Ord. 4618, Feb. 19, 2014; amended by Ord. 4627, April 2, 2014) after the City Council found that aggressive panhandling created safety risks and accosted captive audiences on public roads. GJMC § 9.05.040 bans panhandling City-wide between one-half hour after sunset and one-half hour before sunrise, and separately bans panhandling that involves intimidating, threatening, coercive or obscene conduct causing the solicited person to reasonably fear for safety; fighting words likely to provoke a breach of the peace; knowingly touching or grabbing the person solicited; continuing to ask after an initial refusal; or obstructing a sidewalk, doorway or passageway so the target must take evasive action.

The section also creates location bans: within 20 feet of an ATM or bus stop, on a public bus, and inside any parking garage, lot or facility. GJMC § 9.05.050 separately bans soliciting money, employment, business or sales from vehicle occupants on a public street or highway where the solicitor must step into the traveled lane, bike lane, gutter or a vehicle parking area, or where a driver cannot safely pull into a legal parking spot to complete the exchange. Grand Junction Police enforce both sections; GJMC § 9.05.060 makes any violation of the chapter a misdemeanor punishable under the general penalty schedule at GJMC § 1.04.090. The chapter's declared purpose (§ 9.05.010) is content-neutral: it targets conduct, place and manner, not the message being solicited, to survive First Amendment review.
