45 governs open containers. 020(A) makes it unlawful to consume or possess an open container of beer, wine, or any alcoholic beverage in a public area, defined to include any public highway, street, alley, walk, parking lot, building, park or other public property, or private property without the owner's permission. Two exceptions apply: public streets or sidewalks covered by a city encroachment permit for a sidewalk cafe or beer garden with on-site sales, and special events, such as a neighborhood block party or fundraiser, where the city has granted a street use or other permit authorizing alcohol consumption.

45. 040 sets fines at not less than $75 for a first offense, $250 for a second offense within a year, and $500 for a third or later offense within a year. 46 as a qualifying nuisance activity that can push repeat offenders in the Center City Business District or a public park toward a public nuisance offender designation.
