Section 11-4-21(a) lists the places covered: streets, roadways, alleys, public parking lots, sidewalks, rights-of-way, and public parks or property in the city; grounds of a public school district or within 300 feet of the school's exterior boundary, unless the drinking happens on private residential property or inside a licensed commercial establishment; and any public park, public place, regional park, recreation facility, or recreational area owned or operated by the city, Orange County, or another public agency. Subsection (b) defines a public parking lot broadly to include any private parking lot that is open to the general public, closing an obvious loophole for shopping center and commercial parking areas.

Subsection (c) sets the penalty: any violation is a misdemeanor, punishable under the Code's general misdemeanor provision. Because the ordinance only lifts the ban with the city's prior written approval, any organized public drinking activity needs advance sign-off from the city rather than relying on a private property owner's permission alone. The Orange County Sheriff's Department, which polices Laguna Niguel under contract, along with code enforcement staff, handles complaints at Laguna Niguel Regional Park and along commercial corridors such as Crown Valley Parkway.
