Laguna Niguel, CA Public Conduct: Outdoor Smoking Restrictions (2026)

Adopted by Ord. No. 2014-176 on June 17, 2014, the city's 'Healthy Parks Ordinance' (§§ 13-1-111 through 13-1-116) bans smoking outright in every city recreational area, defined broadly at § 13-1-113 to include parks, picnic areas, playgrounds, gardens, athletic fields, walking paths, hiking trails, amphitheaters, bike paths, horseback riding trails, sports facilities, skateboard parks, stadiums and other open spaces regardless of any admission fee or age limit. 'Smoking' is defined to reach not just lit cigarettes, cigars, pipes and hookahs but also operating electronic cigarettes and any device producing vapor or aerosol from tobacco, nicotine, marijuana or other plant or herbal material, so vaping in a city park is covered on the same terms as a lit cigarette.

Section 13-1-115 separately bars anyone from intimidating, harassing or retaliating against a person trying to enforce compliance with the smoking ban, or from intentionally or recklessly directing secondhand smoke at someone who has raised a compliance issue. The ordinance states its purpose as protecting public health from secondhand smoke exposure, keeping the city's parks and natural resources clean, and balancing smokers' interests against nonsmokers' and children's right to breathe smoke-free air, while explicitly supplementing rather than duplicating state and federal tobacco law. Enforcement under § 13-1-116 treats every violation as an infraction rather than a misdemeanor, with fines capped at $100.00 for a first conviction, $200.00 for a second conviction within one year, and $500.00 for a third or later conviction within that same one-year window, and those remedies are cumulative with any other remedy available at law or in equity.
