Laguna Niguel, CA Public Conduct: Public Marijuana Use (2026)

Section 9-1-55.1(c)(1) makes personal recreational use, possession, purchase, transport, or dissemination of marijuana unlawful in all areas of the city, carving out only the narrow exception where California law specifically forbids a city from prohibiting the activity. That means a person cannot legally consume marijuana in a park, on a sidewalk, in a parking lot, or on any other public or private property within city limits unless state law affirmatively protects the conduct. Subsection (c)(2) goes further on cultivation: no person may plant, cultivate, harvest, dry or process marijuana plants outdoors anywhere in the city, in any zoning district, and no permit or entitlement of any kind may be approved for outdoor growing.

Indoor cultivation gets a narrower allowance under subsection (c)(3): to the extent state law doesn't allow a complete indoor ban, a person may possess or cultivate no more than six marijuana plants inside a private residence or an accessory structure on the grounds of a fully enclosed private residence; growing marijuana inside any other enclosed structure in the city remains fully prohibited. If state law would actually permit a total indoor ban, the ordinance says indoor cultivation is completely prohibited in the city instead. The same enforcement chain that applies to commercial cannabis activity under Sections 9-1-55.2 through 9-1-55.4 covers personal-use violations as well.
