Louisburg, KS Public Conduct: Public Alcohol Use (2026)

Louisburg City Code § 3-105, Public sale; consumption, makes it unlawful for any person to sell, serve or dispense any cereal malt beverage or alcoholic beverage in any public place not licensed to sell, serve or dispense such a beverage at that public place within or under the jurisdiction of the City. Subsection (b) separately bans drinking or consuming such a beverage in any unlicensed public place. Subsection (c) defines public place expansively to include any street, public thoroughfare, public parking lot, or privately owned parking area made available to the public generally, and specifically reaches any parked or driven motor vehicle situated in those places, plus certain state or governmental subdivision property with narrow carve-outs for leased hotel/motel or airport-authority land.

A separate provision, § 3-104, bars drinking alcoholic liquor on city-owned public property outright unless the Governing Body passes a resolution approving an exception, and § 3-106 separately makes it unlawful to consume either beverage while operating a vehicle on an alley, street or highway. Together these sections function as Louisburg's open-container regime: a driver or passenger with an open beverage on a public street or in a parking lot, and anyone drinking outside a licensed premises, is in violation. Chapter 3 sets no unique fine for § 3-105, so the general penalty in § 1-116 applies to a conviction.
