Section 11-302(a) is the operative prohibition: it is unlawful for any person to deliver, possess, manufacture, have under his control, sell, or offer for sale any drug controlled substance or marijuana as defined in Section 11-301, unless one of the section's narrow prescription-related exceptions applies, such as a pharmacist filling a labeled prescription in good faith or a practitioner delivering a drug in the course of professional practice. Section 11-301 pulls marijuana in through the definition of controlled substance, which points to the Uniform Controlled Substances Act at Chapter 65, Article 41 of the Kansas Statutes Annotated, and separately lists marijuana by name in the drug-paraphernalia definition at subsection (p).

Because § 11-302 is a general possession and control offense rather than a location-specific one, it is the section Louisburg police cite when marijuana is found on a person in a park, street, or other public place, since possessing it there is possession under subsection (a) the same as anywhere else in the City. Section 11-303 exempts pharmacists, practitioners, hospitals, manufacturers, wholesalers, carriers, and law-enforcement officers acting in their official duties. No penalty is written into Article 3 itself, so a conviction is punished under the Code's general penalty at § 1-116: a fine of not more than $499, imprisonment of not more than 179 days, or both.
