Lynwood, CA Public Conduct: Public Alcohol Use (2026)

Lynwood Municipal Code § 3-2, titled Alcoholic Beverages, Consumption Prohibited On Public Property, makes it unlawful to consume beer, wine or any other intoxicating beverage on any public street, sidewalk, alley, highway, playground, public park, or parking lot open to the public. The prohibition is drafted broadly: it reaches any public right of way and any parking lot the public can use, not just parks and sidewalks, so a driver's open beer in a shopping center lot or a passenger sipping wine while walking down a public street both fall inside it.

The Los Angeles County Sheriff's Department, contracted to Lynwood through the Century Station, enforces the section alongside code enforcement officers who can issue citations under Lynwood Municipal Code § 1-6. Because § 3-2 does not set its own punishment, a violation defaults to the general penalty scheme at Lynwood Municipal Code § 1-5: it is treated as a misdemeanor punishable by a fine of up to one thousand dollars, up to six months in the Los Angeles County jail, or both, unless a citing officer or the city prosecutor instead charges it as an infraction.

Section 3-2 also carries a state-law savings clause: the local ban does not apply where state law positively permits or prohibits the same act, which lets the city step back for a state-licensed activity, such as an alcohol-service permit issued for a fenced beer garden on public land. There is no carve-out in the text for special events without such a permit, so organizers of a street festival on Lynwood streets still need a state license and any required city permit before alcohol is served in the closed area, or attendees remain in violation of § 3-2.
