Summary

Vallejo Municipal Code Section 7.76.010 bans drinking, displaying, or possessing an open alcohol container on any public street, sidewalk, park, playground, or public parking lot citywide, plus posted private lots. Section 7.76.015 separately makes it an infraction to carry an open container on or beside a posted liquor store, subject to narrow permitted-event exceptions.

Except as provided in Sections 7.76.020 and 7.76.030, it shall be unlawful for any person to (1) sell or furnish; or (2) drink, consume, exhibit, display or possess; an open container, bottle, can, thermal jar, jug or vessel or other receptacle containing any alcoholic or intoxicating beverage upon any public street, sidewalk, alley, lane, way, highway, or parking lot, or in any public park or playground, or upon any private parking lot, including unimproved land suitable and used for the parking of vehicles, which is open to the public, whether or not any fee is charged for the entry to or use of space in the parking lot, in the city.

C. C. 010 prohibits selling, furnishing, drinking, consuming, exhibiting, displaying, or possessing an open container, bottle, can, thermal jar, jug, or other vessel holding any alcoholic or intoxicating beverage on any public street, sidewalk, alley, lane, way, highway, parking lot, park, or playground, and even on private parking lots open to the public regardless of whether a parking fee is charged. C. (2d), separately makes it an infraction to possess an opened alcoholic beverage container on, or on the sidewalk immediately adjacent to, the posted premises of any off-sale liquor store; those retailers must post permanent warning signs, replace damaged or stolen signs within seven days, and report any damage or theft to public works within forty-eight hours, or the licensee itself is guilty of an infraction.

020 carves out four exceptions: public golf courses and driving ranges under the operator's own rules; public buildings or facilities under a written permit; Greater Vallejo Recreation District parks in designated picnic areas or under a District permit reviewed by the chief of police; and any location covered by a city manager permit, appealable to the city council within ten days of denial. 030 requires that any permitted sale also carry a State Department of Alcoholic Beverage Control license filed with the chief of police before sales begin.
