Casa Grande, AZ Public Conduct: Public Marijuana Use (2026)

Casa Grande Municipal Code Chapter 8.30, adopted to protect the health, safety and welfare of the community, prohibits marijuana activity on public property to the fullest extent allowable by law. Section 8.30.030(A) makes it unlawful to sell, distribute, store, cultivate, manufacture or produce marijuana on property occupied, owned, controlled or operated by the City; to smoke marijuana or consume marijuana products in an open space in the City or on city property; or to smoke marijuana in a public place. Section 8.30.020 defines open space as a public park, sidewalk, walkway, trail, preserve, pedestrian thoroughfare or public right-of-way, and public place by cross-reference to the Smoke-Free Arizona Act, A.R.S.

Section 36-601.01. The chapter separately bars operating a marijuana establishment or testing facility in the City (Sections 8.30.040, 8.30.050) except for a dual licensee that jointly operates a nonprofit medical marijuana dispensary and marijuana establishment, and bars delivery of marijuana except by a nonprofit medical marijuana dispensary complying with state Department of Health Services rules (Section 8.30.060). Enforcement runs through the Casa Grande Police Department, and any chapter violation not otherwise designated defaults to a Class 1 misdemeanor under Section 8.30.070(C), subject to A.R.S. Sections 36-2853 and 36-2854.
