Littleton, CO Public Conduct: Public Marijuana Use (2026)

Section 6-4-104(C) of the Littleton City Code states that it is unlawful for any person to openly and publicly consume marijuana, with no age exception, adopted by Ordinance No. 26, Series of 2013. The prohibition sits inside a broader marijuana section that also caps possession at two ounces for any adult regardless of age (subsection B) and bars anyone under twenty-one from possessing marijuana at all (subsection A), so a public-consumption charge often accompanies a possession charge. Unlike most Title 6 offenses, public marijuana consumption carries its own fine schedule rather than falling to the city's general penalty: subsection (E)(2) punishes a conviction for public consumption, for possessing more than two ounces, or for an unlawful cultivation violation, with a fine of not more than $100 and twenty-four hours of community service.

Every person convicted under the section, including for public consumption, also owes a separate $50 surcharge under subsection (F), paid to the Littleton Police Department through the court to offset the cost of destroying seized drugs, injection devices and paraphernalia. The section includes a medical-amnesty provision: a person who reports a drug or alcohol overdose emergency in good faith, stays at the scene, cooperates with responders, and whose own offense arises from that same emergency is immune from arrest and prosecution for public consumption and simple possession violations, and that immunity extends to the person who overdosed.
