405, adopted by Ordinance No. 010-20 on September 15, 2020, sits in Article 4, "Additional Nuisance Related Activities," of the Title 4 public-safety nuisance chapter. It reads simply: no person shall evacuate their bowels or bladder in any public place, or upon any private property, at a place not provided for that purpose. "Public place" is not narrowed to any single location; the adjacent breach-of-peace section, Sec. 402, uses parks, greenways, landscaping medians, common city spaces, streets, sidewalks, and alleyways to describe the same term, so the ban reaches all of those settings as well as private property used the wrong way.

02 governs: a first violation is punishable by a fine of up to $100, a second violation of the same section within a year up to $200, and each further violation within that year up to $500. Each day a violation continues counts as a separate offense. 410 additionally classifies any Municipal Code violation, including this one, as a public nuisance subject to the abatement and cost-recovery procedures set out earlier in Chapter 8, so the City can pursue civil nuisance abatement in addition to, or instead of, an infraction citation. 403.
