Louisiana protects agricultural land uses from local zoning that conflicts with the Right to Farm Law and authorizes parishes to designate agricultural districts for preservation.
Under La. R.S. 3:3603 and related provisions, parish and municipal zoning authorities cannot enact ordinances that declare bona fide agricultural operations a nuisance when they comply with state law and accepted practices. La. R.S. 3:3654 enables formation of agricultural areas to preserve farmland. Title 33 grants parishes general zoning authority but limits restrictions on agricultural activities such as poultry housing, livestock confinement, and crop spraying when conducted lawfully.
Conflicting local zoning ordinances are subject to challenge as ultra vires; aggrieved farmers may seek injunctive and declaratory relief and recovery of attorney fees in some cases.
