Caldwell, ID Sidewalk & Pedestrian Rules: Sidewalk Repair (2026)

Section 05-01-01 places the duty to construct, repair and maintain a safe, nonhazardous sidewalk on the property owner whose land the sidewalk fronts. The City Council can independently deem any sidewalk unsafe and, by a two-thirds vote, order it replaced or repaired at the owner's expense; the owner then gets written notice and sixty days to complete the work (§ 05-01-03). If the sidewalk is not fixed within that sixty-day window, the City has it replaced or repaired by contract and assesses the cost against the property, though the City schedules and pays for repairs to sidewalk damage the owner did not cause if funds are available.

Under § 05-01-09, an owner who fails to construct or repair a sidewalk after notification can have the Mayor and City Council order the work done anyway, with the resulting cost becoming a lien on the property. New or replaced curbs also trigger a separate duty: the owner must maintain a level, unobstructed four-foot strip behind the curb, kept in hard-packed dirt, mowed grass, gravel or City Engineer-approved material (§ 05-01-05). All sidewalk construction and repair must follow the City's adopted 'Sidewalk Construction and Improvement Standards' on file with the City Engineer (§ 05-01-07).
