Summary

Dublin places the duty to repair and maintain the sidewalk area, from the property line to the street line, on the owners of adjacent lots, who must keep it safe and pay the cost. If an owner fails to fix a dangerous sidewalk within 30 days of notice, the city does the work and liens the property for the cost.

Obligation to Repair and Maintain. The owners of lots or portions of lots adjacent to or fronting on any portion of a sidewalk area between the property line of the lots and the street line, including landscape planting strips, sidewalks, retaining walls, curbs and gutters, and persons in possession of such lots by virtue of any permit or right, shall repair and maintain such sidewalk areas in a condition that is not dangerous to property or to persons using the sidewalk in a reasonable manner and will not interfere with the public convenience of said sidewalk area. The owners shall also pay the costs and expenses therefor.

Full Breakdown

1 obligates owners of lots adjacent to or fronting any sidewalk area, meaning the strip between the property line and the street line, including landscape planting strips, sidewalks, retaining walls, curbs and gutters, to repair and maintain that area in a condition that is not dangerous to persons or property and does not interfere with public convenience. 390. Subsection D imposes a duty of care toward the public: failure to maintain the sidewalk area in a nondangerous condition is negligence, and an owner or possessor who fails to repair can be held liable for resulting injury or property damage.

500. Subsection C allows the city to recover its repair costs, including inspection and administration charges, through the assessment procedure in Chapter 22 of Division 7, Part 3 of the state Streets and Highways Code, though the same subsection notes the city budgets funds annually and may choose to permanently repair certain sidewalks itself. 2 borrows the definition of 'sidewalk' from California Streets and Highways Code Section 5600.

Violations & Fines

An owner who ignores a repair notice faces the city performing the work and recording a lien against the property under Dublin Municipal Code Section 7.04.500 for the full cost, including inspection and administration charges. An owner who fails to maintain the sidewalk area also assumes negligence liability under Section 7.04.420.D for any resulting injury to a person using the sidewalk, independent of any city enforcement action.

Frequently Asked Questions

Who is responsible for fixing a cracked sidewalk in front of a Dublin home?
The owner of the adjacent lot. Dublin Municipal Code Section 7.04.420.B.1 requires owners fronting a sidewalk area to repair and maintain it in a condition that is not dangerous, at their own expense, including curbs, gutters and retaining walls in that strip.
What happens if a Dublin homeowner does not fix a dangerous sidewalk after notice?
The city repairs it and records a lien on the property for the cost. Section 7.04.420.E gives the owner 30 days after notice under state Health and Safety Code Sections 5611 to 5614 before the city steps in and bills the property under Section 7.04.500.
Can a Dublin property owner be sued if someone trips on their sidewalk?
Yes. Section 7.04.420.D makes failure to maintain the sidewalk area a form of negligence, and the owner or possessor of the property can be held liable for resulting injury or property damage to a member of the public.
