Laguna Niguel regulates non-commercial and political signs content-neutrally under LNMC 9-1-71.1(g), 9-1-74(m), and 9-1-77(15). Seasonal temporary non-commercial election signs are capped at four square feet and five feet tall, may go up 45 days before an election, and must come down within five days after.
The city's sign ordinance is codified at LNMC 9-1-70 et seq. Section 9-1-71.1(g) establishes content neutrality: wherever the code permits any sign, a non-commercial sign of the same physical dimensions is permitted in its place. Section 9-1-74(m) allows seasonal temporary non-commercial election signs: each may not exceed four square feet or five feet in height; placement no earlier than 45 days before an election in which Laguna Niguel voters participate; and removal within five days after. Section 9-1-77(15) prohibits signs on public streets and rights-of-way but allows seasonal non-commercial signs only in designated rights-of-way, at a four-square-foot aggregate, five-foot height, and no more than three signs per area. Because of the First Amendment, the rules cannot favor one viewpoint.
Posting oversize or over-height political signs, placing them in undesignated rights-of-way, leaving them up over five days after an election, or affixing them to poles, hydrants, or trees violates LNMC 9-1-74 and 9-1-77. The city may remove them.
