Fresno, CA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Placing tables, chairs, or dining furniture in the public right-of-way is regulated separately from private-property patios under FMC 15-2744(C). Subsection (C)(1) requires a Zone Clearance for any outdoor seating in the right-of-way, and any furniture or structure permanently attached to the sidewalk additionally needs an encroachment permit approved by the City Engineer. Downtown establishments face a tighter music rule than elsewhere in the city, amplified sound must not be audible 200 feet outside the dining area downtown, versus not audible at the property line everywhere else.

Access standards are specific: at least six feet of unobstructed sidewalk must remain for pedestrians (measuring around parking meters, signs, trees, and planters), and where the cafe sits next to a street the operator must keep an 18-inch clearance from the curb face, expanding to two feet if cars park parallel along that curb. Before the city issues the permit, the applicant must carry public liability insurance sufficient to cover bodily injury and property-damage claims, naming the City of Fresno as an additional insured, and must sign an agreement, recorded with the County Clerk, acknowledging the permit is temporary, vests no permanent right, and can be revoked on 30 days' notice or immediately if the use becomes dangerous.

The city also charges a fee for the right-of-way space used, and can suspend or prohibit the sidewalk cafe's operation at any time if problems or conflicts arise in the use of that sidewalk area.
