Eagan, MN Special Events & Permits: Street Fair Rules (2026)

Eagan regulates street fairs, festivals and similar gatherings through its special event permit ordinance, City Code § 7.07, rather than through a separate 'street fair' chapter. The purpose clause and definitions in Subd. 1 and 2 expressly list 'street dances, parties or fairs' alongside parades, farmers' markets, and art or craft fairs as events covered by the section whenever they occur on city-owned property or a public right-of-way, including streets, sidewalks and trails. A permit under Subd. 3 is required whenever the event needs street or intersection closures, will significantly interfere with vehicular or pedestrian traffic, or requires city services such as personnel, traffic control devices, sanitary facilities or cleanup that would not otherwise be needed.

Purely private, for-profit sales events built around advertising a single business don't qualify for a permit, though the ordinance carves out farmers' markets and art or craft fairs from that exclusion. Applicants must file with the city clerk at least 60 days before the event date under Subd. 5(A), along with a nonrefundable application fee set by council resolution; a special event permit committee made up of representatives from parks and recreation, police, fire, public works, community development, administration and the city clerk's office reviews every application.

Before the permit is issued, Subd. 5(B) requires the sponsor to sign an indemnification agreement and carry commercial general liability insurance naming the City of Eagan as an additional insured, with at least a $1,000,000 combined single limit and $2,000,000 aggregate limit for the duration of the event, plus a deposit equal to 125 percent of the city's estimated cost for personnel and services, due seven business days before the event. Vendors selling goods at a permitted festival separately need a vendor permit or registration under the city's peddler and transient-merchant rules in § 6.36.
