Sec 5-295, Zoning Restrictions And Requirements, is the operative fencing rule inside Article 5-2F Swimming Pools. It first classifies a swimming pool as a structure, so it falls under the same setback and placement rules that apply to any other structure in the zoning ordinances. It then sets the physical barrier standard: the pool, whether in-ground or above-ground, must be completely enclosed by a fence at least four feet in height, with any opening in the fence less than four inches wide, and every gate serving that enclosure must be both self-closing and self-latching.

The same section requires a sanitary sewer hookup at installation for draining and backwashing the pool, and if a pool is later removed, the owner must level any resulting holes or indentations so they do not collect water or create a public health nuisance under the city's nuisance code. A property owner who cannot meet the zoning setback or enclosure rules can seek a special variance, but only through the board of adjustment, which must approve the hardship request before the variance takes effect; the building official does not have authority to waive Sec 5-295 alone.

The fencing standard applies on top of, not instead of, the permitting chain in Sec 5-289 through Sec 5-294, so a pool contractor must both pull the erection permit and build the compliant enclosure before the pool passes the building official's inspection under Sec 5-294.
