Unlike Texas Health & Safety Code Chapter 757 (which regulates only multi-occupancy pools), Rowlett Code of Ordinances Sec. 78-311 imposes barrier rules on every residential pool, spa or hot tub. The fence, wall or solid structure must completely surround the pool and be not less than 48 inches in height, with no openings larger than four inches measured in any direction (picket spacing measured horizontally). Horizontal members may not be arranged to allow climbing. Gates and doors opening into the enclosure must be self-closing and self-latching, with the latch attached to the upper quarter of the gate, a minimum of 45 inches above ground. A door of an occupied dwelling forming part of the enclosure is exempt. The city's pool handout further details the adopted ISPSC/IRC barrier standards: the barrier top must be at least 48 inches above grade, the gap between grade and the bottom of the barrier no more than 2 inches, openings must not pass a 4-inch sphere, chain-link mesh is limited to 2.25 inches, and pedestrian gates must open outward, be self-closing and self-latching. Plans must show compliance, and the permanent fence must be installed, inspected and approved at the pre-plaster stage before any water is placed in the pool.
It is unlawful to maintain any pool, spa or hot tub that is not fenced per Sec. 78-311. Final inspection and approval are withheld until barrier requirements are met; non-compliant temporary fencing during construction triggers reinspection fees and citations.
