Article XI of Chapter 87, Outdoor Water Pools, opens with a blanket compliance mandate at § 87-75: it is unlawful to construct, maintain, install or enlarge any outdoor water pool in a residential zone except in compliance with the entire article. The article's threshold definition matters as much as the permit rule itself. Section 87-76 defines a 'water pool' as any receptacle or artificial pool with water more than two feet deep at any point and a plane surface area greater than one hundred square feet, so a small kiddie pool or shallow wading pool under that size falls outside the law and needs no permit.

Once a pool meets that definition, § 87-77 requires a permit from the Director for construction, installation, enlargement or alteration, subject to all other applicable provisions of the Town Code. Getting the permit means submitting drawings under § 87-79 to the Director of Engineering Services showing lot lines, the pool's location and construction, the fence that will enclose it, the water supply system, and the drainage and disposal system, plus vertical elevations. Pool walls and floors must be built of an impervious material strong enough to hold the water in a tight tank under § 87-78, and once approved, the pool, its fencing and its drainage must be built to match the approved plans exactly under § 87-79(C).

Water draining or overflowing from the pool has to stay on the owner's own land and cannot run onto a neighbor's property or into the street, per § 87-80.
