Code § 206-6A requires all totes and recyclable containers to be moved to the right-of-way or pavement line in front of the premises by the person producing the solid waste. on the day of collection. Section 206-6C requires totes and recyclable containers to be removed from the right-of-way within 12 hours after being emptied, and stored behind or beside a structure on the property, not in the defined front yard area, and at least 10 feet from any neighboring structure or building. Outside of collection, § 206-5C requires totes to be kept clean and, except when placed at the curb for pickup, stored on the property that produced the waste.
These placement rules apply across the unincorporated Town, since § 206-1B limits the whole article to the area outside the Villages of Sloan and Depew.
Violations & Fines
A violation of the placement window or removal timing is punishable under § 206-10B on the same escalating schedule as other article violations: $25 for a first offense, $50 for a second, and $100 to $500 for a third or subsequent offense. Continuing noncompliance can also be prosecuted under § 206-10C as a separate daily offense punishable by up to a $250 fine or 15 days' imprisonment, or both.
