Cheektowaga, NY Trash & Recycling: Illegal Dumping (2026)

Section 206-8B of the Town Code prohibits carting, dumping, burning or depositing any solid waste on a public highway, street, other public place, or private property, except through the authorized collection process or under the direction of the Sanitation Department head or Recycling Contractor. Chapter 206's penalty section, § 206-10F, makes unauthorized dumping punishable by a mandatory fine of $1,000, separate from the graduated $25-$500 fines that apply to ordinary collection violations, and scavenging discarded rubbish carries its own mandatory $250 fine under § 206-10G.

A second, older provision reinforces the ban Townwide: § 153-12 of Chapter 153 (the sanitary landfill chapter) states flatly that dumping garbage, trash, junk or waste material is prohibited everywhere in the Town except in areas approved for sanitary landfills, with violations of that chapter separately punishable by up to $100 or 15 days' imprisonment plus a $100 civil penalty per day under § 153-14. Ownership of rubbish set out for lawful curbside collection vests in the Town under § 206-7E, making it a separate offense for anyone without Town authority to collect, pick up or remove it.
