Full Breakdown
Section 167-3 governs set-out for garbage and rubbish in Stafford Township, including Manahawkin. No person can place materials or the receptacles containing them for collection prior to 5:00 p.m., local time, 24 hours prior to the day the materials are to be collected in his particular zone (§ 167-3C). The occupant of a residential dwelling must then remove all containers for garbage, rubbish, ash or recyclable materials from the street or curbline by 10:00 a.m., local time, of the day after the Township has collected from them (§ 167-3H).
In areas designated for automated trash containers, all garbage and rubbish must go in containers either provided by or approved by the Township, and nothing is placed outside a receptacle. The Township collects no more than three trash receptacles per collection day per property, and receptacles should be placed a minimum of three feet apart (§ 167-3D). Containers sit on the curb in front of the dwelling, and the dwelling's owner is jointly and concurrently responsible with the occupants for compliance (§ 167-3A).
Automated trash containers are the charcoal gray ones, sold in 96-gallon, 64-gallon and 38-gallon sizes at the most recent bid price, and each property is limited to purchasing two additional automated trash containers (§ 167-4A, C). No person can break into containers of garbage, rubbish, ash or recyclables left on the streets or sidewalks, and owners and occupants cannot permit it for materials placed at or near the curb (§ 167-3F). The Superintendent of Public Works determines the days of the week for collection, with public notice to residents (§ 167-5), and the 5:00 p.m. opening is measured from that day.
Recycling toters follow a separate clock in Chapter 166: § 166-5A allows set-out after 5:00 p.m. the day before but no later than 6:00 a.m. on collection day, with removal by 7:00 p.m. on collection day.
Violations & Fines
Any person who violates, fails or refuses to comply with a provision of Chapter 167 is liable to a penalty of not less than $50 nor more than $1,250, or imprisonment in the county jail not exceeding 90 days and/or up to 90 days of community service, in the discretion of the court. Each day the violation continues is a further and separate offense (§ 167-6). The Superintendent of Public Works or his designee and the Code Enforcement Officer enforce (§ 167-5.1).
