Full Breakdown

Section 167-3 opens by stating that its regulations govern the collection and removal of garbage, rubbish, ash, yard waste, bulk waste and recyclable materials in Stafford Township, including Manahawkin. The occupant of any dwelling house or other residential building places the materials for collection in an appropriate place on the curb in front of the dwelling, after separation in appropriate separate containers. The owner of the dwelling is jointly and concurrently responsible with all occupants for compliance (§ 167-3A). No more than three recycling toters per collection day per property are collected by the Township (§ 167-3B).

Municipal pickup is residential only. No garbage, rubbish, ash, yard waste or recyclable materials are collected by the Township from any manufacturing, commercial office or other business establishment (§ 167-3G). Items must be source-separated for collection at the curb, and metal and recyclables are placed separate from bulk trash (§ 167-3I). The Township does not collect hazardous materials, including but not limited to asbestos, gasoline, paints and oils (§ 167-3J).

The Superintendent of Public Works determines the days of the week when collections are made, and public notice is given to residents (§ 167-5). Related curb rules sit in the same section: a 5:00 p.m. earliest set-out the day before, a limit of three trash receptacles per property, and removal of containers by 10:00 a.m. the day after pickup (§ 167-3C, D, H). Dumping garbage, rubbish, ash, yard waste or recyclables on public property, or trespassing to deposit them on another person's land, is unlawful (§ 167-3E), and no person can break into containers left on the streets or sidewalks (§ 167-3F). Section 167-1 makes it unlawful for the occupant of any dwelling house, store or other building to place garbage, rubbish, ash or recyclables on any street, sidewalk, gutter, areaway or public place except in compliance with Chapters 167 and 166.

Violations & Fines

Any person who violates, fails or refuses to comply with a provision of Chapter 167 is liable to a penalty of not less than $50 nor more than $1,250, or imprisonment in the county jail not exceeding 90 days and/or up to 90 days of community service, in the discretion of the court. Each day a violation continues is a further and separate offense (§ 167-6). The Superintendent of Public Works or his designee and the Code Enforcement Officer enforce (§ 167-5.1).

Frequently Asked Questions

Does the Township pick up trash from businesses?
No. Section 167-3G says no garbage, rubbish, ash, yard waste or recyclable materials are collected by the Township from any manufacturing, commercial office or other business establishment. Commercial and institutional properties arrange their own service, and recycling duties for them sit in Chapter 166.
Who decides which day my trash is picked up?
The Superintendent of Public Works determines the days of the week when collections are made, and public notice must be given to Township residents (§ 167-5). The Code does not print a fixed weekday, so the notice from the Department of Public Works controls.
Does the Township take paint or gasoline?
No. Section 167-3J provides that the Township shall not collect any hazardous materials, including but not limited to asbestos, gasoline, paints and oils. Appliances, electronics and tires are also refused as bulk waste under § 167-3L.
Is a landlord responsible when tenants break the pickup rules?
Yes, jointly. Section 167-3A makes the owner of the dwelling house or other residential building jointly and concurrently responsible with the occupants for compliance with Chapter 167. The penalty under § 167-6 runs from $50 to $1,250 per violation.
