Full Breakdown

Section 184-2 of the Stafford Township Code makes regular solid waste collection mandatory. Every responsible solid waste generator whose waste is not picked up by the municipal solid waste collection service in the Township must enter into a contract with a person lawfully providing private collection services within the Township. The generator then files a notice with the Township Clerk giving the name and address of the collection service and the duration of the contract. Section 184-1 defines regular solid waste collection service as the scheduled pickup and removal of solid waste at least once a week, and a responsible generator includes any owner, tenant or occupant of a single-family residential dwelling or multiple dwelling, or the owner of a commercial or institutional building.

Section 184-3A creates one exception. A single-family or multifamily responsible generator need not contract with a private vendor when transporting the waste generated at his or her residential premises directly to the solid waste facility utilized by the municipality for disposal. Under § 184-3B, every 12 months a person within the exception files proof with the Township Clerk that the waste was taken directly to that facility at least once. Proof of collection service means a written record, log, bill or document evidencing receipt of service for the preceding month.

The Township Clerk notifies all responsible generators of these requirements once every six months, posting the notice in a public place where public notices are customarily posted, and can also advertise in a newspaper circulating in the municipality (§ 184-4). The owner of a multiple dwelling or commercial establishment must provide a sufficient number of solid waste containers for nonrecyclable waste (§ 184-5).

For properties on the municipal route, Chapter 167 sets the schedule: the Superintendent of Public Works determines the days of the week when collections are made, and public notice is given to residents (§ 167-5). The Township collects nothing from any manufacturing, commercial office or other business establishment (§ 167-3G).

Violations & Fines

Anyone violating Article I of Chapter 184 faces a fine of not less than $100 nor more than $1,000, imprisonment up to 90 days, or any combination of fine, imprisonment and community service set by the Municipal Court Judge. Each successive day is a separate offense, and the person allowing the violation to continue can be punished for each one (§ 184-7A). A court can also abate the violation summarily by restraining order or injunction (§ 184-7B).

Frequently Asked Questions

Do I have to pay for trash service in Stafford Township?
Yes, one way or another. If the municipal solid waste collection service does not pick up your waste, § 184-2 requires a contract for regular collection with a person lawfully providing private services in the Township, and a notice to the Township Clerk with the hauler's name, address and the contract duration.
Can I take my own trash to the facility instead?
Single-family and multifamily residents can, under § 184-3A, if they transport the waste from their residential premises directly to the solid waste facility the municipality uses. Every 12 months they must file proof with the Township Clerk that they did so at least once (§ 184-3B).
Who sets the Township pickup days?
The Superintendent of Public Works determines the days of the week when collections are made, and public notice is given to Township residents (§ 167-5). The Code prints no fixed weekday, so the Department of Public Works notice is the schedule to follow.
How often does the Township Clerk remind residents of the requirement?
Once every six months the Township Clerk notifies all responsible solid waste generators of the article's requirements, posting the notice in a public place where public notices are customarily posted (§ 184-4). The Clerk can also advertise in a local newspaper or add a notice to mailings sent to taxpayers.
