Colonie, NY Trash & Recycling: Dumpster Rules (2026)

Town Code § 62-45M, amended 7-23-2015 by Local Law No. 9-2015, sets the Town's only dedicated limit on temporary dumpsters: it treats them as permitted accessory equipment but caps how long one can sit on a residential parcel. The 30-day annual limit does not apply while an active building permit has been issued for the property, so a homeowner mid-renovation can keep a dumpster longer, but that exception drops away once work covered by the permit has stopped for 30 days. On top of the duration cap, the section limits every residential parcel to one temporary dumpster at a time, so a property cannot host two roll-offs simultaneously even if each individually would fall inside the 30-day window.

The rule sits inside the same property-maintenance subsection that restricts oversized refuse containers from front and side yards, so a dumpster placement can trigger both the size/location standard and the 30-day cap depending on where and how long it sits. Enforcement runs through the Building Department Manager under § 62-46: a notice of violation for a property-maintenance issue like this gives the owner 14 days to remove or relocate the dumpster, with the right to request a Town Board hearing within five days of service.

If the owner does not comply, § 62-48 authorizes the Town to remove the condition and assess the cost, including attorney's fees, as a lien on the property collected the same way as Town taxes.
