Dade City, FL Trash & Recycling: Dumpster Rules (2026)

Dade City Code of Ordinances § 74-33 sets the maintenance standard for every garbage can and mechanical container in the city, and § 74-31 defines 'mechanical container' as any container for refuse that is emptied by mechanical means, which covers the commercial dumpsters used by businesses, restaurants, and multifamily properties, and separately defines a 'roll-off container' as a container for construction or demolition debris hauled off on a specially equipped truck. Under § 74-33(a), every can and mechanical container must be kept in good condition and repair and fitted with a cover tight enough to keep flies and insects out, and containers holding wet garbage must be watertight.

The city public works director inspects containers and has authority to approve or condemn any unit that fails to meet the standard, and § 74-33(b) allows no appeal from a condemnation except to the city manager. Businesses that use mechanical dumpster service pay separately from can-based residential accounts: § 74-38(3) bills dumpster users by the cubic yard, per collection, per week, at rates set in the city's hauling contract, plus a ten percent franchise fee added to the gross collection charge. Chapter 74 does not set a placement setback specific to dumpsters the way it does for household cans under § 74-32; a dumpster's location on a commercial site is instead controlled through the site's approved development plan rather than a chapter 74 distance rule.

A dumpster or can condemned under § 74-33 must be replaced before service resumes, and continued use of a condemned or leaking container remains subject to the chapter's general penalty.
