Sec. 24-28(a) puts the duty on the property: every household, multifamily building of four units or more, public building and commercial establishment must keep adequate bulk containers with tightfitting covers or doors, watertight construction, and lifting lugs and dumping bales built for collection trucks. City enforcement personnel can inspect and condemn a container that is unfit, unsafe, unsightly, uncovered or unsanitary, and the owner or user must fix or replace it immediately. Sec. 24-28(c) requires the container to sit somewhere collection trucks can always reach, clear of ground-level or overhead obstructions, and, unless it is rolled roadside solely for pickup, it has to stay inside an approved enclosure that meets Sec.
4 of the Code. Sec. 24-28(d) makes it unlawful to park a private dumpster in a street, alley or public right-of-way except for the time it takes to be serviced. Adjacent commercial or multifamily properties can share one dumpster only with the city manager's approval, only if they are contiguous, never across a street from each other, and only after one location agrees to be the account of record responsible for the whole arrangement, per Sec. 24-28(b). Sec. 24-28(e) sets the spacing for shared collection: containers must sit in one place, easily reached by trucks, within two feet of the roadside and at least two feet from any obstacle or from each other.
Violations of the dumpster rules are punished under the general Chapter 24 penalty at Sec. 24-2, per Sec. 1-6 of the Code, with each day of noncompliance a separate offense.
