Section 154.31 puts the duty on every owner, agent, tenant, occupant, corporation or other entity or person in control of residential or commercial real property not to create or maintain a blighted premises. Section 154.32(4) lists a dumpster or other refuse container on a residential construction site as one of the conditions that makes a lot "not being maintained" and therefore blighted, unless a construction, improvement or other project is about to commence or was completed within one month. Leave the container sitting with no active project bracketing that one-month window and the site qualifies as blighted.

The Town Planner, Building Official, Director of Health or another Enforcement Officer the Mayor designates enforces the rule under § 154.33. Under § 154.35, the town serves a certified-mail notice giving the party in control ten calendar days to remove the container or otherwise correct the condition, and the notice must set forth the fines that apply. Section 154.36(B) fines an occupied blighted premises $150 per day, rising to $250 per day if the property is unoccupied, and to $1,000 per day once the same property has three or more violations within a 12-month period.

The cited party may contest liability before the town's citation hearing officer within ten days, and any unpaid fine becomes a lien on the property enforceable like a tax lien under Conn. Gen. Stat. § 7-148aa.
