Sec. 58-35 flatly prohibits depositing or burying, or causing to be deposited or buried, any noxious, filthy, malodorous or offensive liquid or solid material, garbage, solid waste, refuse or rubbish on any land, public square, street, alley, sidewalk, bridge, storm sewer, vacant or unoccupied lot, lake, canal, creek or watercourse within the city. The same section prohibits keeping such material anywhere in the city except in the type of container specified in Chapter 58 and set out for regular collection. It separately bans burning refuse or solid waste anywhere within city limits, except as otherwise provided by law.

A companion provision, Sec. 58-6(c), makes it unlawful to bury solid waste anywhere in the city or to burn solid waste within the corporate limits. Sec. 58-6(e) adds that it is unlawful to deposit solid waste on the premises of another person or on any street, alley, parkway, other public property, canal, ditch, waterway, river, ocean, beach, pool or pond, or in another person's refuse container, except where a landlord has authorized tenants to share containers. Sec. 58-6(d) makes unlawful accumulation of solid waste on any premises for more than four days without arranging for disposal by the collector.

Enforcement runs through Sec. 58-4, which punishes chapter violations either under general penalty Code Sec. 1-15 or through the code enforcement process in Chapter 2, Article VI.
